Terms of Service

These Terms of Service ("Terms") govern your access to and use of Trace's websites, software, and related services ("Services") offered by Trace Labs ("Trace," "we," "us"). Trace provides revenue attribution and smart-link analytics for sellers and marketers—commonly those using Whop to run memberships, digital products, and checkouts—so you can see which posts and channels actually drive purchases.
By creating an account, clicking to accept, or using the Services, you agree to these Terms. If you use Trace on behalf of a company, you represent that you have authority to bind that organization.
Whop & third-party platforms
Parts of Trace rely on integrations with Whop and other third-party platforms. Your use of Whop remains subject to Whop's terms and policies. We are not responsible for Whop's availability, pricing, payout policies, or moderation decisions. If an integration breaks because a platform changes its API or policies, we will work to restore functionality but do not guarantee uninterrupted access.
Accounts & eligibility
You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account. We may suspend or terminate accounts that violate these Terms or present security risk.
Plans, trials, and billing
Features and limits depend on your plan. Fees, renewals, and refunds for paid plans are handled through the checkout flow presented at purchase—today that is commonly Whop checkout—and any additional terms shown at payment apply. Taxes may be added where required. We may change pricing with reasonable notice; continued use after a change may constitute acceptance.
License to use Trace
Subject to these Terms and your payment status, we grant you a non-exclusive, non-transferable license to access and use the Services during your subscription. You will not (and will not permit others to) reverse engineer, scrape, overload, or probe the Services in ways that harm stability; resell Trace without authorization; circumvent usage limits; or use the Services to violate law or third-party rights.
Your content & data
You retain rights to your business data, campaign labels, and content metadata you submit. You grant Trace a license to host, process, and display that information solely to provide the Services (including attribution, reporting, alerts, and product improvement). You represent that you have the rights needed for us to process data you submit, including data about your buyers or clickers where applicable.
Attribution & analytics disclaimer
Trace helps you model which touchpoints correlate with revenue using the data sources and rules you configure. Attribution is inherently probabilistic: cross-device journeys, platform limitations, ad blockers, cookie restrictions, and timing differences can affect results. Reports are for business insight, not audited financial statements. You remain responsible for tax, accounting, and compliance decisions.
Acceptable use
You agree not to use Trace to:
- Violate law or infringe intellectual property or privacy rights.
- Send deceptive or malicious links, phishing, or malware—whether or not through Trace-generated URLs.
- Harass, discriminate, or promote illegal goods or services using our infrastructure.
- Attempt unauthorized access to Trace, other customers' data, or underlying systems.
Intellectual property
Trace owns the Services, including software, branding, templates, and documentation. Feedback you give us may be used without obligation to you. Third-party marks (for example platform logos shown for attribution context) belong to their owners.
Disclaimer of warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT RESULTS WILL BE ERROR-FREE OR THAT THE SERVICES WILL MEET EVERY REGULATORY REQUIREMENT IN YOUR INDUSTRY WITHOUT YOUR OWN REVIEW.
Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRACE LABS AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL. OUR AGGREGATE LIABILITY FOR CLAIMS ARISING OUT OF THESE TERMS OR THE SERVICES WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TRACE FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), EXCEPT WHERE LIMITATION IS PROHIBITED BY LAW.
Indemnity
You will defend and indemnify Trace and its team against claims arising from your use of the Services, your content, your links, or your violation of these Terms or third-party rights—except to the extent caused by Trace's willful misconduct.
Termination
You may stop using Trace at any time. We may suspend or terminate access for breach, risk, or extended non-payment. Provisions that by nature should survive (disclaimers, limitations, indemnity, and dispute-related provisions) will survive termination.
Disputes
If you have a concern, contact us on Whop (@ceoofitall) first so we can try to resolve it informally. These Terms are not tied to the law of any single state or country: your relationship with Trace is governed by the laws that apply to you and us in your situation, including consumer-protection rules where you live, when those laws cannot be waived. If informal resolution fails, disputes may be brought only in courts that have competent jurisdiction over the matter and the parties under those applicable laws.
Changes
We may modify these Terms by posting an updated version and changing the "Last updated" date. Material changes may include additional notice. Continued use after changes become effective constitutes acceptance.
